DAVID COLE, III

David Cole, III, is Of Counsel at BurgherGray. He is an accomplished business, litigation, and compliance attorney with a wide-ranging practice that includes commercial litigation, government and internal investigations, corporate compliance, and enterprise risk management. With extensive experience advising corporate leadership across industries, David is known for delivering practical and comprehensive legal solutions and helping clients navigate high-stakes legal challenges with confidence and precision based on a 360-degree view of the law obtained from experience as in-house counsel, outside counsel, and as a prosecutor.

In government, David served as an assistant attorney general in the Illinois Attorney General’s Office Special Litigation Bureau, where he prosecuted civil and criminal fraud cases, including health care fraud, consumer fraud, charitable trust fraud, and False Claims Act cases.

David spent more than a decade in various high-level in-house positions in the pharmaceutical, financial services, and education industries. Among his experience as in-house counsel, David served as head of litigation for a global education corporation where he managed the company’s global litigation portfolio which included a diverse docket of consumer and commercial matters across business lines, including class actions and individual litigation, government investigations and enforcement actions, and internal investigations.

David has also advised clients in several major industries on compliance issues, including the Foreign Corrupt Practices Act. He advises clients on a broad range of compliance risks, designs and helps implement compliance programs, and conducts risk assessments. David has led several internal investigations arising from conduct in Asia, Europe, Latin America, and North America.

David was also an attorney at an Am Law 100 law firm where he represented clients in commercial litigation, government and internal investigations, consumer fraud, class action lawsuits, and white-collar criminal matters.

David earned his J.D. from Loyola University School of Law, and a B.A. in Political Science from Clark Atlanta University. David is licensed to practice in Illinois.
