Appellate Litigation
BurgherGray attorneys handle appeals in federal and state appellate courts throughout the country, as well as in agency proceedings. Our attorneys take a creative approach to appellate advocacy and offer a range of appellate services, including, briefing and arguing appeals on the merits; petitioning for or opposing motions seeking discretionary review, mandamus, or other extraordinary relief; preparing amicus briefs; and advising clients on appellate issues that may arise during litigation and trial.
Representative Transactions
- Defended a direct marketing client in an action brought by the Social Security Administration, which sought penalties and injunctive relief for deceptive advertising. In a remarkable victory, our attorneys had the agency’s administrative action dismissed by an appeals panel.
- Argued appeal before the Second Circuit Court of Appeal and subsequently submitted an emergency petition for certiorari to the United States Supreme Court in a Fair Housing Act case alleging racial discrimination.
